A lawsuit filed against AllianceOne by an individual named Wayne Norman accused the company (who’s main specialty is debt collection) of violating the TCPA (Telephone Consumer Protection Act) by using an autodialer to call him multiple times on his cellphone. Norman claimed that there was a “dead air” or “pause” before being connected with a representative from AllianceOne, indicating the use of an autodialer to make phone calls to his cell phone.
After an investigation and evidence presented by the Vice President of the company, call records indicated that the calls to Mr. Norman were placed manually, and that AllianceOne didn’t have the software capabilities to make automated calls to begin with. As such, the case was dismissed by the United States Court of Appeals for the Seventh Circuit. This is not the first time that Norman has filed a suit against the company for violation of the TCPA, according to court documents there have been previous incidents that have either been settled out of court or dismissed as well.
